Each subsequent Florida DUI charge brought against you will result in increasingly harsher penalties. These penalties are listed under Florida’s drunk driving law. For a second DUI conviction within five years, the penalties imposed include:

  • A five year license suspension
  • Jail time of 10 days to nine months
  • Fees and court costs of $1,000 to $2,000
  • Probation of up to a year
  • Vehicle impoundment for 30 days
  • The use of an ignition interlock device for at least one year

For a third conviction within 10 years, the penalties are increased to:

  • 10-year license suspension
  • Jail or prison time of 90 days up to five years
  • Fees and court costs of $2,000 to $3,000
  • Vehicle impoundment of 90 days
  • The use of an ignition interlock device for a minimum of two years

Per the law, anyone arrested for a fourth or subsequent DUI regardless of when previous convictions occurred will be charged with a third degree felony. Third degree felonies carry a general sentencing term of five years in a Florida prison.
