Well, in Florida there’s actually only one machine that can be used in DUI cases. The State of Florida has only approved the Intoxilyzer 8000 for breath testing. None of the other machines that are in use throughout the country can be used in the State of Florida.

If somebody tried to use one of those machines and a got a result for a breath alcohol level on one of those machines the results would not be admissible. But it is important to have an attorney who knows everything that they can about the Intoxilyzer 8000, and that’s one of the differences at Katz & Phillips. Our attorneys are trained on this instrument, and in fact I train other attorneys. My partner and I both travel around the country holding training seminars dealing with the Intoxilyzer 8000 and problems with it and ways to defend cases against the breath test or cases where a breath test result is being offered against the client when the breath test is given  on the Intoxilyzer 8000.
